By accessing and using this App or any related services, you accept the following terms and conditions. Please read these terms carefully. They make a legally binding contract with you (the person or organisation using and accessing the App) and us (Z Energy 2015 Limited, NZ company no. 4482).

In this section, we explain how you can download and start using our App.
To use the Caltex App, you must download the App from the app store and follow the set-up process described in the App. You will need to have an active internet connection. Your mobile device will need to use a software version that supports the App.
You may only have one App account at any time. You are not allowed to hold multiple accounts.
To use this App, you must be over the age of 16.
You are responsible for protecting your passwords and other private user credentials and for any usage of your user credentials. You must notify us immediately on becoming aware of any actual or suspected unauthorised use of your user credentials.
Alternatively, you can elect to link your Facebook or Google account to create a Caltex App account.
If you elect to link your Facebook or Google account to the App, we will receive information from those accounts (such as your email address). The type and quantity of information we receive from those services depends on your personal settings and privacy policies within those third-party accounts.
This section outlines what you can and can’t do with our App. Please take some time to familiarise yourself with our App ‘ground rules’.
You can use the App and its features in the ways described in these terms.

You agree to comply with any Z safety rules related to use of electronics on Z premises, including not using your device (such as a smartphone or tablet) in any prohibited areas.
We use your data for several reasons, including to help provide services to you. This section outlines how we deal with your personal information like your name and email address.
To use our App, you must provide certain personal information.
Any personal information you provide us will be dealt with in accordance with these terms and our Privacy Policy.
In addition to the purposes listed in our privacy policy, we may use any information you provide us to:
No data transmitted via the App can be guaranteed to be secure. Any information you submit through the App is done at your risk.
You can request to close your account via the App at any time. You can do so by following the process in the App to close your account, or alternatively by contacting us. We will delete your data once we no longer need it for any purpose for which it was collected, this generally occurs within a 6-12 month timeframe. Check out our privacy policy for information on how we collect, handle, and process your data.
Please note that in some cases we may be obliged to retain your information, for example to comply with data retention laws.
You promise that all information you provide us is true, accurate and correct.
Some features of the app (including Pay-in-app) can only be used if you input credit, debit or other payment card details. We explain more about this in following sections.
When you input your payment card data into the App, it will be provided to Worldline, who securely holds the details on their system.
We will never see nor store the details of your payment cards - such details are collected, stored, and processed by Worldline through their ‘Click’ service. For further information regarding World, and how it encrypts and processes Caltex App transactions, see the Worldline website.
This section outlines some important legal terms, including when we can change these terms, the App, and what we will be responsible for if things go wrong.
The App will evolve over time as we continue to improve our service.
IMPORTANT! We may change these terms from time to time. The changes will take effect when we publish them on the Caltex website. By continuing to use the App, you’ll be taken to have accepted the latest version of these terms, and it’s up to you to check for any changes.
Z may change the format and content of the App at any time. Z may suspend the operation of the App for support or maintenance work, in order to update the content, or for any other reason.
Additional terms may apply to specific goods or services or online tools provided through the App. If there is any inconsistency between these terms and the product or tool-specific terms, the product or tool-specific terms will prevail.
The App contains material which is protected by copyright and/or other intellectual property rights. All copyright and other intellectual property rights in this material, and all trademarks are either owned by us or are used by us under licence.
The App may include links to external websites. We do not endorse or assume any responsibility for the content of those links.
We may terminate or suspend your access to all or part of the App at any time, for any reason, and without giving you notice. We do not need to give you a reason for any termination or suspension.
All information or advice included on the App is intended to be general in nature and you should not rely on it in connection with any decision you make. Z tries to ensure that all information provided in the App is correct but does not guarantee its accuracy.
IMPORTANT! To the extent permitted by law, we are not liable for any action you may take as a result of relying on such information or advice, or for any loss or damage suffered by you or any third party as a result of you or a third party taking this action.
To the extent permitted by law, we will not be liable for any loss or damage (direct or otherwise) you or any third party suffer in connection with the use of the App or the use of, or reliance on, content contained in or accessed through the App. To the extent permitted by law, we also exclude any condition or warranty that could be implied into these terms.
We are not liable to you for any failure or delay in performance of our obligations under these terms arising out of any event or circumstance beyond our reasonable control.
Like any online service, we cannot guarantee that the Caltex App will be uninterrupted or error-free. It is up to you to take any precautions necessary to ensure you do not incur losses or costs if the Caltex App is affected by an interruption or error.
You must always have a means to pay for their Fuel purchase that does not involve using the Caltex App, just in case the Caltex App is unavailable.
We make no representations and give no warranties that the App will be capable of running on your iPhone, iPad, Android device computer equipment and software.
We give no warranty that the App will be free from technical glitches, computer viruses, worms, software bombs, Trojan horses or similar items.
We will not be liable for loss, corruption of, or damage to data, or viruses or similar items that may infect your iPhone, iPad, Android device computer equipment and software due to your use of the App.
These terms and conditions are governed by the laws of New Zealand.
The Pay-in-app feature provides you with the convenience of paying for fuel in the App on arrival at any participating Caltex stations as an alternative to paying in store.

To use Pay-in-app, you must register your valid and non-expired credit card or debit card issued by a New Zealand bank, or a Z Business Card issued by Z Energy which is eligible at Caltex.
Yes! Pay-in-app supports payments using Z Business Card. Standard Z Business Terms and Conditions also apply.
If you use a Z Business fuel card for Pay-in-app, there is no ability for an odometer reading to be recorded, and no PIN will be required.
Before a Pay-in-app transaction is authorised by the App, a check is done to make sure that the Z Business fuel card is not over its designated limit. However, it is possible that a Z Business fuel card will be under its designated limit before the Pay-in-app transaction, but the purchase could cause the limit to be exceeded.
It is your responsibility to ensure that you are operating within the limit of your Z Business fuel card. Where you use a Z Business fuel card as the payment card, any restrictions set up by the account holder as to the type of fuel that can be purchased, will also apply to the Pay-in-app transaction.
If you select a type of fuel in the App that is not authorised by the account holder, the transaction will be declined.
You will not be able to register or continue to use a payment card for Pay-in-app if it has expired, has been reported stolen by the issuer of your payment card, or is no longer eligible for use in the App for any reason.
If your mobile device or your physical payment card is lost or stolen you must immediately cancel all digital occurrences of that payment card as registered on your App account. You can email caltexnzapp@z.co.nz for help deleting or cancelling all digital occurrences of their Credit and Debit Card with App.
You acknowledge that registering your payment card in App provides for a Card Not Present digital occurrence of your physical card. Therefore while you have a payment card registered for Pay-in-app, if your physical card is cancelled, or expires, the payment card registered on your account will also be cancelled or expired and Pay-in-app will not be available. If you choose to cancel or deregister from the App, or delete the App altogether, this will have no effect on your physical payment card which you will still be able to use.
You authorise a pre-authorisation hold against your credit card account (for credit cards) or bank account (for debit cards), or Z Business account, for Z Business fuel cards, equal to the Pay-in-app purchase limit you have set in the Z App (including GST).
A pre-authorisation hold will be made each time you authorise payment using a payment card for Pay-in-app.
You give authorisation for a pre-authorisation hold each time you use or attempt to use Pay-in-app.
Multiple pre-authorisation holds may occur from time to time. You should contact the issuer of your payment card (including us, in the instance of Z Business fuel cards) for any queries regarding these.
If a pre-authorisation hold is not granted for any reason (for example, insufficient funds are detected, or you your credit limit would be exceeded), you will not be able to proceed with your Payin-app transaction.
We are not responsible for, and have no influence over, the time it takes for your bank (who issued your payment card) to release a temporary hold or pre-authorisation hold. If you have any queries on this, we suggest you contact the issuer of your payment card.
Pay-in-app uses location services on your mobile device. For the pay-in-app feature to work Location Services are required to be turned when the App is in use.
IMPORTANT! Your location data may be ‘personal information’. We collect and handle personal information in accordance with our privacy policy.
31. Additional discounts and prize draws
If you are a Pay-in-app user, we may from time to time add additional discounts to any ‘stacked’ Pumped balance you may have and/or enter you into prize draws. Whether we do any of these things is entirely our decision.
You can earn Airpoints Dollars™ or Flybuys on your Pay-in-app fuel purchases. If you use Pay-in-app with your Z Business Card, you will collect Airpoints Dollars™ or Flybuys in accordance with how your account has been set up.
A GST receipt will be issued by email to you after each fuel purchase within the App.
The digital price board feature provides you with the ability to view digital price boards at participating Caltex stations for all fuel within an approximate 10-kilometre radius from your location.
The digital price board feature is a trial product, and so may quickly change as we tweak and refine it based on what we learn during the launch period. If you have any feedback, we’d love to hear it!
The digital price board function can only be used if you have enabled location services on their device. If you do not enable location services their device, you may be unable to use the digital price board function.
IMPORTANT! Your location data may be ‘personal information’. We collect and handle personal information in accordance with our privacy policy.
You may use the digital price board for personal informational purposes only.
IMPORTANT! You must not use any information connected to the digital price board function for any other purpose, including any business purpose whatsoever or any commercial exploitation. You must not copy or ‘screen-scrape’ any information from the digital price board or the Caltex App.
IMPORTANT! To the extent permitted by law, you agree to defend, indemnify and hold us harmless against all losses, liabilities, claims (including third party claims), damages, fines, penalties, costs and expenses that were caused or contributed to otherwise arise from your breach of the digital price board do’s and don’ts.
However, you will not be liable to the extent that we have caused or contributed to such losses through our own negligence, breach of these terms or unlawful conduct.
While we strive to ensure our prices presented in the digital price board are up to date, we cannot guarantee they will always be accurate. We take no responsibility for your reliance on information in the digital price board.
Yes! You can choose to display prices with the Pumped discount applied, by following the steps in the App.
Please note that some Caltex sites occasionally hold special (non-Pumped) discounts. The App does not display non-Pumped discounts, and you will not be able to display prices with non-Pumped discounts applied.
Not currently. While the majority of our sites are signed-up to digital price board, there are a few sites that will not be visible, and the digital price board will not display those sites’ pricing information.
